Welcome To Use LinknLink Cloud Service Platform!
This Terms of Use and the attached "LinknLink Privacy Policy" (hereinafter referred to as the "Agreement") are jointly signed by you and Hangzhou LinknLink Technology Co., Ltd. (hereinafter referred to as "Link&Link").
Before accepting the agreement, please read the entire content of this terms carefully and fully understand the terms, especially the restrictions or disclaimer. The restrictions or disclaimer will be highlighted in bold or other prominent form to remind you to pay attention.
If you have any questions about the terms of this agreement, please contact the relevant business department of Link&Link to inquire. Unless you have read and accepted all terms of this agreement and related agreements and rules ect. , you are not authorized to use this service. Once you choose "agree to the agreement and submit" (Please refer to the registration page for specific wording ) and complete the registration process, or you use the service in any way, it is deemed that you have read and agreed to be bound by the above terms, rules, etc. If you violate this agreement, we have the right to unilaterally take measures such as restricting, suspending or terminating the provision of services to you at any time according to your violation, and have the right to hold you accountable.
The service agreement (hereinafter referred to as "this agreement") is jointly signed by you and Hangzhou LinknLink Technology Co., Ltd. (hereinafter referred to as "LinknLink"). Including but not limited to: "Link&Link Cloud Service Platform Privacy Policy" and other content. If there is any change to this agreement, LinknLink will make an announcement on the official website www.linknlink.com without prior notice. Once the changed agreement and rules are announced, they will automatically become part of this agreement, without further notice to you. If you do not agree with the relevant changes, please stop using the service immediately. If you continue to use it, it is deemed that you have no objection to the revised rules and agree to abide by them.

1. Definition Of Nouns
1.1 Licensed software: refers to the software system developed by Link&Link or you to download from the platform and install and use in the mobile terminal of the limited system. Such as Link&Link Android APP, etc.
1.2 Service: refers to the service provided by Hangzhou LinknLink Technology Co., Ltd. for you. You can use the service on mobile terminals and other smart devices through the licensed software.
1.3 Smart device: refers to the smart devices of the ecological partners of the company and the company's cloud service platform, including but not limited to power monitoring boxes, centralized controllers, smart sensors, cloud projection boxes, smart remote controls, smart gateways, etc.

2. Service
2.1 LinknLink provides you with smart device management services. You can control the smart device terminals connected to the LinknLink cloud platform through LinknLink intelligent control, and realize the linkage between smart devices. The service content includes intelligent device management, intelligent control software upgrade, scenario linkage, analysis reports, etc. These functional services may be optimized or modified according to changes in user needs or the unilateral judgment of the service provider, or may be subject to regular or irregular maintenance. temporarily stop providing services.
2.2 According to the situation of the servers deployed by Link&Link in Europe (Germany), China, the United States and other countries and regions, LinknLink will, after obtaining your consent, upload the local data generated by your use of the service to the most recent according to the laws and regulations of the country where the user is located. The compliance is most suitable for the server in your location; at the same time, you can request to backup, delete, or download the data uploaded to the cloud.

3. Service Scope
3.1 LinknLink gives you the right to use this product and control your smart life device with regard to this software
3.2 The software operates in the following ways and requires your cooperation:
(1) When you install and start the app the first time : the application data storage folder is created, the push SDK is initialized, the LinknLink App SDK is initialized, and the data reporting SDK is initialized. When the app is installed and started for the first time, you will be asked to select a country or region; after selecting a country or region, the app will download the multilingual resource file corresponding to the mobile phone language from the server corresponding to the currently selected region.
(2) Login operation: When you log in, the server corresponding to the selected region will be preferentially used to log in, but if you are in the EU, the server in the EU will be preferred; if you are in North America, the server in North America will be preferred by default.
(3) Registration: In first, please check whether the registered account is registered in the three servers. If it is already registered, it cannot be registered again. If not registered, use the corresponding server in the country selected by the user to register.
(4) If you're signed in via Google connect, you will obtain data such as home, room, and device list after logining successfully, and the data will be reported to Google at the same time.
3.3 LinknLink will update, upgrade or transfer the Licensed Software and its related functions from time to time. If there is no clear independent agreement for the above-mentioned new functions and services, this agreement shall apply, and you can still obtain the authorization of the corresponding functions and services, and this agreement shall apply.
3.4 You are responsible for the accuracy, reliability, completeness and legality of the input data and the legality of the way you obtain the data, and you should regularly back up data, materials, etc. You assume the entire risk of damage to or loss of such data.
3.5 You should keep your account number and password properly. If you find that your account has potential security risks (including but not limited to leakage of user passwords), you should notify us in a timely manner, and we will assist you in taking relevant measures. Otherwise, you shall be responsible for all actions under your account, and you shall bear all responsibilities.

4. Third-Party Apps And Services
4.1 You already know that some of the services of Link&Link may be obtained based on software or services provided by third parties, which are set up for your convenience and have been legally authorized by the third party.
4.2 Some of the information and services of third parties contained in this product are not under the control of LinknLink, and LinknLink is not responsible for the information and services of such third parties.
4.3 You understand that Link&Link cannot guarantee that the licensed software will permanently use or include this service, nor can it guarantee that it will continue to use other software provided by the same third party in the future, and may also use similar services of other third parties. The above-mentioned corresponding software or services, once activated, the provisions of this agreement shall also apply.

5. Specifications About Using The Service
5.1 You may not license, sell, lease, transfer, release the product in any form or apply the product to other commercial use.
5.2 Due to the limitations of software adaptation platforms and terminals, you can only use the licensed software on authorized system platforms and terminals. If you install the licensed software on other terminal devices, it may cause damage to your hardware or software functions.
5.3You should understand that the Licensed Software may only be used for non-commercial purposes and may not install, use, or run the Licensed Software for commercial purposes. If necessary, the written authorization and permission of Link&Link must be obtained in advance.
5.4 You should regulate the use of the licensed software, the following ways are against the regulations of use:
1)Post or share computer viruses, worms, malicious code, software that intentionally damage or alter computer systems or data.
2)Unauthorized collection of other users' information or data, such as email addresses, etc.
3)Malicious use of this product in an automated manner, causing undue burden on servers or other interfering with or damaging website servers and network links.
4)Attempts to access server data or communication data of this product without authorization.
5)Interfere with or destroy the use of other users of this product.
5.5 What you should understand and agree:
1)LinknLink will determine whether you are suspected of violating the above-mentioned usage specifications, and will suspend or terminate your license or take other restrictive measures according to the agreement.
2)For the information that you publish when you use the licensed software that is suspected of breaking the law or infringing the legal rights of others or this agreement, LinknLink will directly delete it.
3)If your violation of the above-mentioned usage rules causes damage to any third party, you need to bear the legal responsibility independently in your own name, and you should make sure that the company is free from any loss or increased expenses, otherwise the company has the right to claim compensation from you.
4)If you violate the relevant laws or the provisions of this agreement and cause Link&Link to suffer any loss, you shall compensate LinknLink for the losses and/or expenses incurred thereby.

6. Specification About Information Content
6.1 You promise not to use this service for any illegal or improper activities, including but not limited to the following behaviors:
6.1.1 Upload, transmit or share information that contains one of the following:
1) Against the fundamental principles established by the constitution.
2) Endanger national security, divulge state secrets, subvert state power, and undermine national unity.
3) Damage to national honor and interests.
4) Incite ethnic hatred, ethnic discrimination, or undermine ethnic unity.
5) Those who undermine the state's religious policy and promote cults and feudal superstitions.
6) Spreading rumors, disrupting social order, disrupting social stability.
7) Those who spread obscenity, pornography, gambling, violence, murder, terror or instigate crime.
8) Insulting or slandering others, or infringing on the legal rights of others.
9) Contains false, deceptive, harmful, coercive, invasive, harassing, invasive, libelous, vulgar, obscene, or other morally objectionable content.
10) Containing any other content restricted or prohibited by applicable laws, rules, regulations, ordinances and any norm with the force of law.

7. Privacy Policy And Data
7.1 Protecting your personal information is very important to LinknLink. We will manage your personal information in compliance with the privacy laws and regulations of the place where the smart device is used. In addition, LinknLink has formulated the LinknLink Privacy Policy, which makes important disclosures on the ownership and protection of intellectual property rights, as well as your information collection, use, sharing, storage, and protection. It is recommended that you read the "LinknLink Privacy Policy" in its entirety.
7.2 In principle, we conduct compliance management according to the privacy laws and regulations of the place where smart devices are used.

8. Intellectual Property
8.1 You understand and agree that all products, technologies, software, programs, data and other information (including but not limited to text, images, pictures, photos, audio, video, graphics, All intellectual property rights (including but not limited to copyrights, trademark rights, patent rights, trade secrets, etc.) and related rights of color, layout design, electronic documents) are owned by Link&Link or its affiliates.
8.2 Unless authorized in writing by LinknLink, you shall not (and shall not allow any third party) to implement the above-mentioned rights, including but not limited to renting, lending, selling, distributing, copying, modifying, reprinting, compiling, publishing, reproducing engineering, reverse assembling, decompiling or other discovering source code or publishing programs or content.
8.3 The LinknLink service may involve third-party intellectual property rights. If the third party has requirements for the intellectual property rights involved in your use of the LinknLink service based on this agreement, you should abide by the same.
8.4 It is your duty to respect intellectual property rights. If you violate it, you will be liable for damages.
8.5 You understand and agree to authorize Link&Link to use your name, trademark and logo in publicity and promotion, but only to indicate that you belong to our customers or partners.

9. Disclaimer
9.1 Except as expressly stipulated by laws and regulations, Link&Link will do its best to ensure that the licensed software and the technology and information involved are safe, effective, accurate and reliable, but limited by the existing technology, LinknLink cannot guarantee this.
9.2 Please understand that for your direct or indirect losses caused by force majeure and third-party reasons, Link&Link is not responsible for it.
9.3 Personal injury or incidental or consequential damages arising out of or in connection with any of the following situations shall be borne by you:
1) Unapproved use of licensed software by third parties or changes to your data.
2) Expenses and losses for use of licensed software.
3) Your misunderstanding of licensed software.
4) Other losses related to the licensed software not attributable to Link&Link.
9.4 Any other software derived from licensed software that is not developed and officially released without the authorization of LinknLink belongs to illegally downloading, installing and using such software. It may lead to unpredictable risks, and the legal liabilities and disputes arising therefrom have nothing to do with LinknLink, and LinknLink has the right to suspend or terminate the license and/or all other services.
9.5 You have learned that the use of the LinknLink platform involves Internet services and may be affected by unstable factors in various links, although Link&Link has taken security measures, the service may still be subject to inherent defects in the Internet and electronic communications and events beyond the reasonable control of either party to this agreement (including, without limitation, fires, floods, terrorist attacks, plagues, natural disasters, riots, terminal viruses, hacker attacks, network failures, terminal failure), suspension, interruption, delay, restriction or impossibility of use. You hereby deliberately assume the above risks, and agree that when the actual occurrence of the above-mentioned risk events affects the normal operation of the service, Link&Link does not have to bear any responsibility to you.

10. Termination Of Agreement And Liability For Breach Of Contract
10.1 You should understand that the use of the Link&Link service requires the use of the licensed software within the scope of authorization, respect for the intellectual property rights of the software and the content contained in the software, the use of the software in accordance with the regulations, and the performance of obligations in accordance with this agreement. If you seriously violate this agreement, LinknLink will terminate the license.
10.2 Your use of the software depends on the supporting services provided to you by the affiliates of LinknLink. If you violate the terms, agreements, rules, notices and other relevant provisions with LinknLink and its affiliates, you may not be able to use the licensed software normally. The right to take restrictive measures against your license and other rights under the control of the company in the manner agreed in the agreement, including suspending or terminating the license.
10.3 Once you violate this agreement or other agreements signed with LinknLink, LinknLink may notify its affiliates and require them to take restrictive measures against your rights, including requiring the affiliated company to suspend or terminate the provision of some or all of the services to you.
10.4 The licensed software is obtained by downloading from your own download platform (Google, App store, etc.). You need to abide by the download platform, system platform, and terminal manufacturer's agreement on the way and restrictions on your use of the licensed software. If the above-mentioned third party confirms that you violate the agreement, you need to double If it is processed by a third party, LinknLink may terminate your license due to the request of a third party.
10.5 Upon termination of this license, you shall cease using the licensed software and destroy all copies.
10.6 If you violate the terms of this agreement and cause losses to LinknLink or other users, you must be fully liable for compensation.

11. Governing Law And Severability
11.1 The validity, interpretation, modification, execution and dispute resolution of this agreement shall be governed by the laws of the People's Republic of China. If there are no relevant laws and regulations, reference shall be made to the privacy laws and regulations of the country where the smart device is used and general international business practices and/or industry practices.
11.2 Disputes arising out of or in connection with this agreement may be resolved through friendly negotiation with LinknLink or submitted to the Hangzhou Arbitration Commission of Zhejiang Province, China where this agreement is signed for adjudication.
11.3 When any clause of this agreement is ruled invalid by the Hangzhou Arbitration Commission having jurisdiction, it does not affect the validity of other clauses or any part thereof, and you and LinknLink shall still perform in good faith.
11.4 This agreement is signed in Binjiang District, Hangzhou City, Zhejiang Province, China.

12. Effective Notice
12.1 Any notices sent to you by LinknLink may be in the form of e-mails, public area announcements on pages (LinknLink official website, PC-side application software or mobile-end micro-apps), personal network area prompts, mobile phone text messages or regular letters, etc., and such the notice shall be deemed to have been served or effective to the user from the date it is sent.
12.2 Any notices you send to LinknLink should be sent to the online or offline contact information, mailing address, email or other notification methods approved by LinknLink that LinknLink officially announces to the user. The contact information is as follows:
